The Villages HOA Rental Rules Every Owner Needs to Know

Before you list your home, you need to understand your deed restrictions. Here's what the POA can and can't enforce, and how to stay compliant while maximizing your rental income.

The 55+ Age Requirement

The Villages is designated as a 55+ community under the Housing for Older Persons Act (HOPA). At least 80% of occupied units must have at least one resident aged 55 or older. In practice, this means at least one person on the lease must be 55+. Their spouse or partner can be younger.

Children under 19 are generally not permitted as permanent residents, though short-term visits (a few weeks) are typically allowed. Check your specific deed restrictions for guest visitation rules.

Minimum Lease Terms

This is the most important restriction for rental owners. Minimum lease requirements vary by village:

Historic Side (oldest villages)

Minimum: 30 days (most common)

Most flexible area for rentals. Some villages may have slightly different rules.

North of CR-466

Minimum: 30 – 90 days

Varies by village. Check your specific deed restrictions.

South of CR-466 / CR-466A

Minimum: 90 – 180 days

Developer-controlled areas tend to have stricter minimums.

South of SR-44 / Eastport

Minimum: 180 days (6 months)

Newest areas. Strictest rental restrictions.

Tenant Registration

Most POAs require owners to register their tenants. This typically involves submitting:

  • Tenant name(s) and contact information
  • Lease start and end dates
  • Vehicle information (make, model, license plate) for gate access and parking
  • Copy of the signed lease agreement (some POAs require this)
  • Emergency contact for the owner

Parking Rules

Parking violations are the #1 source of tenant complaints to the POA. Key rules:

  • Vehicles must be parked in the driveway or garage — not on the street overnight
  • Golf carts must be stored in the garage or on the driveway, not on the lawn
  • Commercial vehicles, trailers, and boats generally cannot be parked at the home
  • Guest vehicles may be limited to 72-hour stays on the street
  • Some villages restrict the number of vehicles per household

Pet Policies

Pet rules vary by village and by what you allow as an owner. Common restrictions include:

  • Maximum 2 pets per household in most villages
  • Dogs must be leashed in common areas
  • Pet waste must be picked up immediately — this is heavily enforced
  • Some villages restrict specific breeds (pit bulls, Rottweilers, etc.)
  • Weight limits (often 40-60 lbs) may apply in certain areas
  • As the owner, you can set your own pet policy (no pets, small dogs only, etc.) in the lease

Exterior Maintenance

The owner is responsible for exterior maintenance regardless of who lives there. Your lease should clearly state who handles lawn care, pool maintenance, pressure washing, and exterior painting. If your tenant lets the lawn die or the pool turn green, the POA will fine you, not the tenant. Most owners either include lawn and pool service in the rent or require the tenant to maintain a service contract.

Can I do short-term (Airbnb-style) rentals in The Villages?

No. Most Villages deed restrictions require a minimum lease of 30 days. Many require 3 or 6 months minimum. Nightly or weekly Airbnb-style rentals are not permitted in any village.

Do I need POA approval to rent my home?

Most POAs require notification but not formal approval. You typically need to submit a tenant registration form with the renter's name, contact info, vehicle details, and lease dates. Check your specific POA's requirements.

Can the HOA restrict who I rent to?

The HOA cannot discriminate based on protected classes (race, religion, national origin, etc. under the Fair Housing Act). However, they can enforce the 55+ age requirement — at least one occupant must be 55 or older in most Villages neighborhoods.

What happens if my renter violates HOA rules?

The owner is ultimately responsible for tenant behavior. The POA will typically notify you (the owner) of violations. Repeated violations can result in fines levied against the property owner. Include HOA rules in your lease and make compliance a tenant obligation.

Are rental rules different in developer vs resident-owned villages?

Yes. Developer-owned villages (newer areas, mainly south of SR-44) tend to have stricter deed restrictions, often requiring 6-month minimum leases. Resident-owned villages (Historic Side, North of 466) generally have more flexible 30-day minimums. Always check your specific deed.
